The family of an 89-year-old Hayward, California, man who died from injuries sustained in a violent dog bite attack has filed a wrongful death lawsuit in federal court. The victim was bitten by a police department German Shepherd in an incident last May.
Police had been using the dog to search a neighborhood when they lifted the dog over an 8-foot tall wall and let it loose in the victim's yard, whereupon it attacked the man. His leg became gangrenous and although it was amputated above the knee, he died less than two months after the attack.
The lawsuit alleges negligence on the part of local officials and the officers involved.
The victim's family has said they were moved to legal action to help force changes within the police department's handling and training of these dangerous animals.
Though animal attacks are not uncommon, death is a rare result. Many victims are rather left with disabling injuries or disfigurement. Legal action can be a valuable remedy given the wide range of harm animal attacks can cause. In this case, the family looks to honor the victim's legacy by protecting others from a similar fate. By forcing the police department to reevaluate its procedures, the family hopes its officers will be better prepared to handle such a situation in the future.
